Methods

Family lawyer, Li-Shann Durst, makes it her goal to help families navigate the divorce process using alternative dispute resolution methods such as Collaborative LawMediation and Negotiations. She believes these methods offer alternatives to litigation that are less destructive on families. Ms. Durst provides compassionate, prudent counsel and guidance to help her clients navigate their divorce or family law matter.

Collaborative Law

A Collaborative Divorce is one of the most effective methods to handle a divorce outside of court.  Collaborative law allows a team of professionals to come alongside the family to support and guide them through the divorce process.  If necessary, financial experts, child specialists, and other mental health professionals are available to address areas of particular concern to the family.

Mediation

Mediation is another alternative dispute resolution method that is commonly used to help couples resolve their divorce issues.  Mediation works well for those individuals who can advocate for themselves.  The attorney operates as a neutral in the mediation process and guides the parties to resolution.

Negotiation

Most litigated issues are resolved outside of court.  As such, attorneys are actively negotiating amongst themselves and are advising their clients in the negotiation process.  Negotiations can take place between the attorneys or between the parties themselves.  The parties’ decisions are then reflected in an agreement or agreed order which can then be incorporated into the Final Order of Divorce.
